- Separate property: If you have real estate, investments, personal property, a business or other assets prior to marriage, a premarital agreement will list those assets to assure they are recognized as separate property and not subject to community property laws.
- Just in case: No one goes into a marriage expecting to get a divorce, but it should be recognized as a possibility no matter how remote it may seem. You may want to agree in advance that certain acquisitions during a marriage (pensions, 401k accounts, additions to a business) will remain with the acquiring spouse.
