The final decree in a divorce may not address your needs a few years after it is enacted. While you and your ex-spouse may agree to change an order, it must be approved by the court. Our law firm will work with you to get a hearing as soon as possible.
Changes in child support: When there is a substantial change in income in either direction (up or down) or by either parent, there may be a need to modify child support. The court needs to hear the need for change and approve the change. If you can no longer pay the required child support amount, act quickly before you face arrearages. Changes in child support are not retroactive. Talk to your lawyer about asking for a change in support.
Changes in child custody: As children grow up, they may need different custody and visitation arrangements. If one parent becomes unable to care for a child because of health, addiction problems or a new spouse with problems, or if a child has different education or health needs, the court may need to reevaluate child custody.
Changes in spousal support: If there is a change in need (of the person being paid) or in the ability to pay (of the person paying alimony), we can ask the court to review the changed circumstances and change the spousal support.
If you need an effective and experienced family law attorney to help you with post-judgment modifications anywhere in New Mexico, we are available and prepared to represent you. Be aware that if you are in noncompliance with an order, you can be held in contempt of court. Call or e-mail us to set up a consultation.
