A partnership agreement can establish the rights and obligations of both partners. This can help in the event of the dissolution of the partnership or in the event that one partner is unable to make decisions because of illness or disability.

  • How to divide property: You and your partner may decide that property should be divided using the principles of community property even though your partnership is not governed by community property law. Property division decisions need to be in writing in a partnership agreement that will stand up in civil court. Our law firm can help.
  • Establishing rights and obligations: How do you want property to be dispersed if you die before your partner? In a marriage, property would go to the surviving spouse. Do you want property to go to the surviving partner? Cohabitation does not have the force of law accorded to marriage. Make sure your partnership agreement has the effect you want.
  • Discuss the agreement with your lawyer: Each party in a contract — including a domestic partnership agreement — should be represented by an attorney to be assured that each person's rights and interests are protected.

If you need a partnership agreement anywhere in New Mexico, our attorneys are available and prepared to represent you. Call or e-mail us to set up a consultation.
