Grandparents do not have specific rights to visitation in New Mexico. The law considers access to grandchildren a privilege rather than a right. There are circumstances, however, where a grandparent's willingness to care for a child is in the best interests of that child.

  • Parents who cannot parent: Often a parent cannot take care of a child. The parent may have physical or mental limitations. The parent may have died. There may be a drug or alcohol addiction problem. Or the home may be dangerous to children because of other adults in the household. In such cases, a grandparent may step in and ask the court for temporary custody as a kinship caregiver or for guardianship or adoption.
  • Grandparents able and willing to help: If your child has left your grandchild with you or if you want to care for your grandchild, our attorneys will present your case to a court to determine whether you can have custody.
